PlaySound is committed to safeguarding the privacy of the people who use our websites, products and services. This Privacy Policy describes how PlaySound collects, uses, and shares your personal data. You can review this policy at any time in Settings and/or online at playsound.ca/privacy-policy.php. 1. What is Personal Data?
Personal data is information that can identify a specific individual, either by itself or in combination with other information that is linked or can be linked to that individual. For example, personal data includes an individual’s name, address, email, telephone number, date of birth, passport number, social security number, fingerprint, driver’s license number, credit or debit card number, and other information.
2. Your Privacy Rights at PlaySound?
At PlaySound, you will always have the right to know, access, correct, restrict the processing of, and delete your personal data. If you would like to obtain a copy of your personal data, you can make a request at support@playpiano.io. There may be circumstances where we cannot grant your request, for example if you ask us to delete your transaction data and PlaySound is legally obligated to keep a record of that transaction to comply with the law. We may also decline to grant your request where doing so would restrict our legitimate use of data for anti-fraud and security purposes. Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, appears to be done for an improper purpose, or would be extremely impractical. You have the right to request that your information not be used for our marketing purposes at any time, by contacting us at support@playpiano.io. You may also contact us at this address to revise your personal information.

3. What Information Do We Collect?
We may collect, store and use the following kinds of personal information in connection with our websites, products and services (our “offerings”):
(a) Account Information. Your account details, including email address, password, and account status.
(b) Device Information. Information about the computer and other devices you use to access and/or use our offerings, such as your device serial number.
(c) Usage Information. IP address, geographical location, browser type and version, browser history, operating system, referral source, length of visit, page views, website navigation, product interaction, crash data, diagnostic data, and other usage data;
(d) Transaction Information. Information relating to any transactions carried out between you and us on or in relation to our offerings, including information relating to any purchases you make of our offerings;
(e) Notification Information. Information that you provide to us for the purpose of subscribing to our offerings, email notifications, new offerings and features, and newsletters; and
(f) Other Information You Provide to Us. Information such as the content of your
communications with PlaySound, including contacts concerning customer support, and contacts through our social media channels.
You are not required to provide the personal data that we may request. However, if you choose not to do so, in many cases we will be unable to provide you with our offerings or respond to requests you may have.
PlaySound may receive information about you from other individuals, from businesses or third parties acting at your direction or on your behalf, form our business and technology partners who help us provider our offerings and assist us in security and fraud prevention, and from other lawful sources. We may collect information about you from other individuals; for example, if that individual has sent you a gift card, contacted you through a PlaySound product, service, or forum, or shared content with you. We may also validate the information you provide (such as information to create a user account), with a third party for security, and for fraud prevention.
4. PlaySound’s Use of Personal Data
PlaySound may use personal data to provide our products and services, to process transactions with you, to communicate with you, for security and fraud prevention, and to comply with law. We may also use personal data for other purposes with your consent. PlaySound may rely on the fact that the processing is necessary to fulfill a contract with you, protect your vital interests or those of other persons, or to comply with law.
(a) Provide Our Services. PlaySound collects personal data necessary to provide our services, which may include personal data collected to improve our offerings, for development of new offerings, for internal purposes such as auditing or data analysis, or for troubleshooting. For example, if you access a song through Play Piano, we collect data on what songs you play in order to provide you with the content you requested and for the purpose of paying music royalties.
(b) Communicate With You. PlaySound may use your personal data to respond to communications, contact you regarding your account or transactions, provide other relevant information, or request information or feedback. We may also use your data to send important notices, such as changes to our terms, conditions, and policies. Because this is important information about your relationship with PlaySound, you may not opt out of receiving these important notices.
(c) Security and Fraud Prevention. We may use your personal data for loss prevention (protection against theft of our products or services) and to prevent fraud, including the protection of PlaySound, its employees, staff, agents, and contractors, and for the benefit of all our users. We may also use your data in scanning uploaded content for potentially illegal content, including child sexual exploitation material.
(d) Personalization. If we provide a product or service that enables you to personalize your user products, services, or communications according to your preferences, then where such options are available PlaySound may use information that we collect so that we can offer you those personalized services or communications.
(e) Legal Compliance. We may use your data to comply with applicable law; for example, to fulfill tax or other reporting obligations, or to comply with a lawful government request.
Currently the consumer financial transactions for our products and services are processed by our payment services providers, Stripe and PayPal. You can review the Stripe privacy policy at www.stripe.com. You can review the PayPal privacy policy at www.paypal.com. We share personal data with our payment processors only to the extent necessary for the purposes of processing payments you make via our products and services and for dealing with complaints and questions relating to those payments.
PlaySound does not use algorithms or profiling to make any decision that would significantly affect you without the opportunity for review by a person. PlaySound also does not use or disclose sensitive personal data for any purposes that would require a user to exercise a right to limit processing according to California law.
PlaySound retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy or as required by law.
5. PlaySound’s Sharing of Personal Data
PlaySound may share personal data with PlaySound-affiliated companies and with PlaySound’s officers, employees, agents, contractors, subcontractors, service providers who act on our behalf, business partners, developers, publishers, or others at your direction. PlaySound may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing data, including personal data, in connection with your use of our services and delivering our offerings to customers. PlaySound service providers are obligated to handle personal data consistent with this Privacy Policy.
We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or users, or in the event of a PlaySound reorganization, merger, or sale.
We may also disclose your personal data:
(a) In connection with any legal proceedings or prospective legal proceedings;
(b) In order to establish, exercise or defend our legal rights;
(c) To the purchaser (or prospective purchaser) of any business or asset which we are (or are contemplating) selling; and
(d) To any person or entity we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our opinion, such court or authority would be likely to order disclosure of that personal information.
PlaySound does not share personal data with third parties for their own marketing purposes. PlaySound does not sell your personal data including as “sale” is defined in Nevada and California. PlaySound also does not “share” your personal data as that term is defined under California law.
6. Protection of Personal Data
PlaySound takes the security of your personal data seriously. We use administrative, technical, and physical safeguards designed to prevent the loss, alteration, or misuse of your personal information. We store all the personal data you provide on our secure servers. All electronic communications you receive from us are encrypted using SSL technology. Of course, data transmission over the internet is inherently insecure, and we cannot guarantee the security of any data sent over the internet. You are responsible for keeping your password and user details confidential. We will not ask you for your password (except when you log in to a website, product, or service).
7. Cookies
By using our websites, products, and services, and by agreeing to this policy, you consent to our use of cookies in accordance with the terms of this Privacy Policy. A cookie consists of information sent by a web server to a web browser and stored by the browser. The information is then sent back to the server each time the browser requests a page from the server. This enables the web server to identify and track the web browser.
We may use both “session” cookies and “persistent” cookies. We may use the session cookies to keep track of you while you use a website, product, or service. We may use the persistent cookies to enable our websites, products, or services to recognize you when you visit or use the offering. Session cookies will be deleted from your computer when you close your browser. Persistent cookies will remain stored on your computer until deleted, or until they reach a specified expiration date.
Other types of cookies that we may use are:
(a) Communications Cookies. These cookies are used to enable network traffic to and from PlaySound’s systems, including by helping us detect any errors.
(b) Necessary Cookies. These cookies are required to provide a specific service or feature that you have accessed or requested. For example, they enable us to display our websites, products, and services in the proper format and language, to authenticate and verify your transactions, and to preserve the contents of your shopping cart of bag when you are shopping for items, such as MIDI files.
(c) Other Cookies. These cookies are used to understand how users interact with our websites and online services, including by assisting us in assessing the effectiveness of advertisements and web searches for our offerings.
Our payment services providers (currently Stripe and PayPal) may also send you cookies.
If you prefer PlaySound not use cookies, you may disable their use.
Most browsers allow you to reject all cookies, while some browsers allow you to reject just third- party cookies. Blocking all cookies will, however, have a negative impact upon the usability of many websites, products, and services, including our offerings.
8. International Data Transfers
Information that we collect may be stored and processed in and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this Privacy Policy.
Information which you provide may be transferred to countries (including The United States of America) which do not have data protection laws equivalent to those in force in Canada, our home jurisdiction.
In addition, personal information that you submit for publication in or on our websites, products, or services will be published on the internet and may be available, via the internet, around the world. We cannot prevent the use or misuse of such information by others.
By signing up for (creating an account) and/or using our websites, products and services you expressly agree to such transfers of your personal data.
9. Third-Party Websites
Our websites, products, and services may contain links to other websites. PlaySound is not responsible for the policies or practices of third-party websites.
10. Changes to this Privacy Policy
We may update this Privacy Policy from time-to-time by posting a new version on our website. When there is a material change to this Privacy Policy, we will post a notice on the PlaySound website at least a week in advance and contact you directly about the change if we have your personal data.
